TERMS AND CONDITIONS

Please read these terms and conditions carefully before using the web site operated by Equitylink Limited. By accessing or using the web site you agree to be legally bound by these terms and conditions as they may be modified and posted on our web site from time to time.

 

1. PARTIES

These terms govern the relationship between subscribers to the The Momentum Investor and the Small Company Sharewatch and Equitylink Ltd. ("Equitylink"). It commences from the moment that payment of the annual subscription is received by Equitylink Ltd.

Equitylink does not carry out transactions on behalf of customers or hold client money.

2. PRICE AND VAT
Subscribers to The Small Company Sharewatch and The Momentum Investor will receive 12 issues of each publication each year, posted to them during the year of subscription. They will also receive full access to this website.

The price is set out on the Equitylink website on the date of ordering. The electronic website archive is provided free to subscribers who will continue to receive a hard copy of the current publication through the post. Subscriptions to the newsletters are payable in advance.

3. PAYMENT

Membership to the newsletter is via a one off subscription which is payable annually. No online access will be available, nor will print issues be dispatched, until payment is received.

In order to process payments online, Equitylink requires the billing address for the credit card used and its external payment provider, Worldpay, requires your credit card details. Equitylink stores your billing details on its servers in case it needs to contact subscribers in the future regarding payments. WorldPay requires that you provide your credit card details to process the transaction which is done on a secure WorldPay server. Equitylink does not have any access to these credit card details and they are not stored or processed in any way by Equitylink.

4. DISPATCH

Newsletter issues are mailed by 1st class post within the UK and by airmail to the rest of the world.

5. USER NAME AND PASSWORD

This agreement and any rights of access (password and username) provided to you may not be assigned, licensed or otherwise transferred by you to any other person. You agree to keep your password confidential and your user name and password are not transferable. You are responsible for all use of your username and password, whether or not the use is made by you or someone else using your username and password. If you believe there has been a breach of security of your username you should notify Equitylink.

6. RISK WARNINGS

In reading the information contained in the material provided under this contract, no personal recommendation is being made to you; the securities referred to may not be suitable for you and, if you have any doubts, you should seek advice from your investment advisor.

You should appreciate that investing in any of the investments discussed may lose all or part of your money. There is an extra risk of losing money when shares are bought in some smaller companies including penny shares. There is a big difference between the buying price and the selling price of these shares. If they have to be sold immediately, you may get back much less than you paid for them. The price may change quickly and it may go down as well as up. Changes in rates of exchange may have an adverse effect on the value, price or income of the securities. More generally, past performance is no indicator of future performance.

7. ACCURACY OF INFORMATION

Equitylink makes no warranties, expressed or implied, as to the accuracy, adequacy, quality or fitness for any particular purpose of the Information for a particular purpose or use and all such warranties are expressly excluded to the fullest extent that such warranties may be excluded by law. You bear all risks from any uses or results of using any Information.

8. CANCELLATION POLICY

Subscriptions to the newsletters are payable in advance. No refunds are normally made if cancellation takes place part way through a subscription period or once the information has been accessed or posted to you. Should you not wish to renew a subscription paid by credit card (under Futurepay) or by standing order cancellation should be advised in writing prior to renewal. You should also advise your Bank of cancellation if you have paid by standing order or Futurepay if you originally paid by credit card. As we do not hold account information we cannot process it in any way. Breach by a subscriber of any of the terms of this agreement however minor will entitle Equitylink to terminate this contract. Termination of the contract will not result in Equitylink refunding to the customer any sums of money paid under this agreement.

9. COPYRIGHT

Copyright in the material displayed here and in The Small Company Sharewatch and The Momentum Investor remains that of Equitylink and you may use information only for your own personal, non-commercial use which means that you may not sell, resell, retransmit or otherwise make the Information available in any manner or on any media to any third party unless you have obtained Equitylink's prior written consent.

10. AVAILABILITY OF OUR WEB SITE

Equitylink will try to make our web site available but cannot guarantee that our web site will operate continuously or without interruptions or be error free and can accept no liability for its unavailability. Subscribers must not attempt to interfere with the proper working of our web site and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, web site, router or any other internet connection device.

11. YOUR INFORMATION

Equitylink is committed to protecting and respecting your privacy. Our primary goal in collecting personal information from you is to provide you with a smooth, efficient, and personalized experience while using our services. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience easier and quicker.

We may use personally identifiable information about you to improve our marketing and promotional efforts, to statistically analyse site usage, to improve our content and product offerings and to customise our site's content, layout, and services. We believe these uses allow us to improve our site and better tailor it to meet our users' needs.

We may occasionally share your information with organisations who are our business partners. We or they may contact you by mail or e-mail to let you know about any goods, services or promotions which may be of interest to you. When you give us your personal information, we will give you the opportunity to opt out of receiving such information from us but remember that this will preclude you from receiving any of our special offers or promotions in future. You may also exercise your right to opt out of the use of your information for marketing purposes at any time by contacting us.

12. CONFLICTS OF INTEREST

Should Equitylink Limited provide you with information on an investment in which it or its directors or employees has an interest, or where it would give rise to a conflict of interest, we will either disclose this interest to you or decline to provide advice in this investment. 13. COMPLAINTS PROCEDURE

Our aim is at all times to provide you with an excellent service. However, if you are unhappy with our service for any reason you should direct your complaint to the Compliance Manager at Subscriber Services, Equitylink Limited, PO Box 1015, Croydon CR9 5DL. Upon receipt of your complaint, we will enter it on to our complaints register, which records details of your complaint and enables us to track it through to resolution. We endeavour to respond within ten business days. 

14. GOVERNING LAW

This contract and all dealings arising out of it and connection with before or after its conclusion between Equitylink and the customer will be governed by English law.
